Terms of Service
1. Introduction and Acceptance
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Recberry s.r.o. ("Recberry," "we," "us," or "our") governing your access to and use of the Recberry Job Seeker Space platform (the "Service").
BY CREATING AN ACCOUNT, ACCESSING, OR USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT USE THE SERVICE.
1.1 Governing Law – These Terms are governed by the laws of the Czech Republic, specifically: Act No. 89/2012 Coll., Civil Code; Act No. 634/1992 Coll., on Consumer Protection; Act No. 480/2004 Coll., on Information Society Services; Regulation (EU) 2016/679 (GDPR).
1.2 Language – The original language of these Terms is English. In case of any discrepancy between language versions, the English version shall prevail.

3. Definitions
"Service" – The Recberry Job Seeker Space platform, including all features, tools, and content.
"Account" – Your registered user account created through OAuth authentication.
"Free Tier" – One (1) resume analysis, complimentary.
"Paid Tier" – Premium service (€10 one-time payment) providing eleven (11) service runs.
"Credits" – Usage units allocated to your Account.
"Resume Analysis" – AI-powered analysis of your resume content provided by our Service.
"Content" – Text, images, data, or other materials submitted by you to the Service.
"Intellectual Property" – Patents, trademarks, copyrights, trade secrets, and other proprietary rights.
4. Eligibility and Account Registration
4.1 Age Requirement – You must be at least 16 years old. By creating an Account, you represent that you meet this requirement.
4.2 Account Creation – You must create an Account using OAuth (Google, GitHub, or LinkedIn), provide accurate information, maintain security of credentials, and promptly update changes.
4.3 Account Responsibility – You are solely responsible for all activities through your Account, maintaining confidentiality of OAuth credentials, any misuse by third parties, and notifying us of unauthorised access.
4.4 Prohibited Accounts – We may refuse, suspend, or terminate Accounts that violate these Terms, use false information, engage in abuse or illegal conduct, circumvent security, or are used for unauthorised commercial purposes.
4.5 One Account Per User – Each User may maintain only one (1) Account. Creating multiple Accounts to exploit the Free Tier is prohibited and may result in termination.
5. Service Description
5.1 Free Tier – One (1) resume analysis and optimisation; access to analysis results; account dashboard; no payment required; credits do not expire.
5.2 Paid Tier (€10 One-Time) – Eleven (11) total service runs; full access to all seven (7) service types: Resume Review & Optimisation; LinkedIn Profile Alignment; Resume & Cover Letter Tailoring (2×); Ghosting Analysis; Interview Preparation Questions (2×); Interview Evaluation (2×); Live Czech Job Search (2×). Credits never expire; no recurring subscription; priority support.
5.3 Service Availability – Provided "as available"; we strive for 99% uptime but do not guarantee uninterrupted access; scheduled maintenance announced when possible.
5.4 Service Modifications – We may modify, suspend, or discontinue features; change specifications and pricing (existing purchases unaffected); add or remove integrations. Material changes to paid services: 30 days' email notice.
5.5 Beta Features – Features labeled "Beta" or "Experimental" are provided "as-is" without warranties; may be changed or discontinued; may contain bugs; feedback appreciated but not required.
6. AI-Powered Resume Analysis
6.1 Third-Party AI – Resume analysis uses Anthropic Claude AI (USA). Your resume content is transmitted to Anthropic Inc.; processing is real-time and data is not retained by Anthropic; analysis typically takes 30–60 seconds.
6.2 Nature of AI Analysis – You acknowledge: The analysis is advisory only, not professional career counseling; results are generated by AI and may contain errors; we do not guarantee employment outcomes or interview success; human judgment should be applied when implementing suggestions.
6.3 No Guarantee of Results – We disclaim any guarantee that following our recommendations will result in job offers, that your resume will pass any specific ATS, or that our analysis is suitable for all situations.
6.4 Content Recommendations – We strongly recommend removing personal contact information (full name, address, phone, email), using initials, removing national ID numbers and photographs, and focusing on professional content.
6.5 Content Processing – By using resume analysis, you: Explicitly consent to transfer of resume content to the USA; acknowledge Anthropic processes under their Privacy Policy; understand we cannot control Anthropic's processing; accept responsibility for any sensitive information you include.
7. User Content and Intellectual Property
7.1 Your Content Ownership – You retain ownership of content you submit (resume text, analysis input, interest form responses, communications).
7.2 License to Us – By submitting content, you grant Recberry a worldwide, non-exclusive, royalty-free license to use, store, process, and analyse it solely for providing the Service, including transmitting resume content to Anthropic, storing results, and using anonymised aggregated data for improvement.
7.3 Content Restrictions – You agree NOT to submit content that: Violates law; infringes third-party rights; contains malicious code; is false, misleading, fraudulent, offensive, defamatory, discriminatory; violates privacy; contains unsolicited advertising.
7.4 Our Intellectual Property – All Service elements (design, logo, software, code, analysis frameworks) are owned by Recberry. You may not copy, modify, reverse engineer, remove notices, or use our branding without consent.
7.5 Feedback – We may use feedback without compensation; you grant us unlimited, perpetual license to use it; we have no obligation to implement feedback.
8. Payment and Billing (Paid Tier)
8.1 Pricing – Free Tier: €0. Paid Tier: €10 one-time (eleven service runs). Top-Up: €10 (ten additional credits). All prices include VAT (21% in Czech Republic).
8.2 Payment Methods – Stripe: Credit/debit cards (Visa, Mastercard, Amex); SEPA bank transfers; other Stripe-supported methods.
8.3 Processing – Payments processed by Stripe; we do not store card details; confirmation email sent; credits added immediately upon success.
8.4 Invoicing – Automatic invoices sent to your email; comply with Czech tax law; business customers: contact us for VAT ID reverse charge.
8.5 No Refunds – All sales final; no refunds after credits are added. Exception: Technical issues preventing delivery (case-by-case). EU consumers waive withdrawal right by immediately accessing digital content.
8.6 Free Tier Limitations – One (1) resume analysis credit only; creating multiple accounts for additional free credits is prohibited.
8.7 Credit Expiration – Credits never expire; non-transferable; unused credits have no cash value.
8.8 Promotions – Promotional offers subject to specific terms; promotional credits may have different expiration; we may modify or cancel promotions.
9. Prohibited Conduct
You agree NOT to: Create multiple Accounts to exploit free services; share credentials; resell or redistribute access; use for unauthorised commercial purposes; automate access (bots, scrapers); breach security; access other users' data; interfere with Service; introduce malware; copy our content; reverse engineer; harass or abuse; submit false information; impersonate others; violate laws.
Consequences: Immediate suspension or termination; forfeiture of credits; legal action; reporting to authorities.
10. Disclaimers and Limitations of Liability
10.1 "As-Is" – Service provided "AS IS" and "AS AVAILABLE" without warranties of merchantability, fitness for purpose, non-infringement, uninterrupted operation, or accuracy.
10.2 No Employment Guarantees – We disclaim any guarantee that use will result in job offers, your resume will be selected, or our analysis is suitable for all situations.
10.3 Third-Party Services – We are not responsible for failures of OAuth, AI, or payment processors; third-party breaches; or third-party privacy practices.
10.4 User Content – We are not responsible for accuracy, quality, legality of User Content; consequences of including sensitive information; or employment decisions by third parties.
10.5 Limitation of Liability
(A) We shall not be liable for indirect, incidental, special, consequential, or punitive damages (lost profits, lost opportunities, lost data, reputational harm).
(B) Total liability capped at amount you paid in the 12 months preceding the claim (or €10 if Free Tier only).
(C) Exceptions: Death or personal injury from negligence; fraud; liability that cannot be excluded by law.
10.6 Indemnification – You agree to indemnify Recberry (officers, directors, employees, agents) from claims, damages, losses, liabilities, expenses (including legal fees) arising from your use, violation of Terms, violation of third-party rights, your Content, or your negligence or willful misconduct.
11. Termination
11.1 Termination by You – Contact barbora@recberry.com or follow Account deletion procedures. Upon termination: Account deleted within 30 days; unused credits forfeited; analysis history lost; we retain data as required by law.
11.2 Termination by Us – We may suspend or terminate immediately if you violate Terms, use Account for fraud/illegal activity, abuse the Service, or if required by law.
11.3 Effect of Termination – Your right to use ceases; you remain liable for obligations; disclaimers, limitations, governing law survive.
12. Modifications to Terms and Service
12.1 Changes to Terms – We may modify at any time; "Last Updated" date changes; material changes notified via email; continued use constitutes acceptance.
12.2 Changes to Service – We may modify features, functionality, pricing; add or remove options; discontinue with reasonable notice.
12.3 Notice – 30 days for changes affecting paid services; 14 days for pricing (new purchases only); reasonable notice for discontinuation.
13. Dispute Resolution
13.1 Governing Law – Czech Republic law, without regard to conflict of law.
13.2 Jurisdiction – Exclusive jurisdiction of Czech courts. Primary: Municipal Court in Prague (Městský soud v Praze).
13.3 EU Consumer ODR – EU consumers may use European Commission Online Dispute Resolution: https://ec.europa.eu/consumers/odr
13.4 Alternative Resolution – Contact barbora@recberry.com; we will make reasonable efforts to resolve within 30 days.
13.5 Consumer Rights – These Terms do not limit statutory consumer rights (Act No. 634/1992 Coll.); you may file complaints with Czech Trade Inspection; additional EU consumer protection rights apply.
14. Miscellaneous Provisions
Entire Agreement – Terms + Privacy Policy constitute entire agreement.
Severability – Invalid provisions modified to reflect intent; others remain in effect.
Waiver – Failure to enforce does not constitute waiver.
Assignment – You may not assign without our consent; we may assign to successor or affiliate.
Force Majeure – Not liable for failure due to circumstances beyond reasonable control (natural disasters, pandemics, wars, government actions, strikes, internet failures, third-party outages).
No Agency – No partnership, joint venture, employment, or agency created.

Electronic Communications – You consent to electronic communications; they satisfy written requirement.
Headings – For convenience only.
Language – English prevails in case of conflict.

16. Acknowledgment
BY CREATING AN ACCOUNT OR USING THE SERVICE, YOU ACKNOWLEDGE: You have read and understood these Terms; you agree to be bound; you have read our Privacy Policy; you are at least 16 years old; you will comply with laws; you understand the nature and limitations of the AI-powered Service; you accept the disclaimers and limitations of liability. If you do not agree, you must not use the Service.
